1. Agreement and scope
These terms apply to your access to the Nutrifunction Meals website and your purchase, pickup, receipt, storage, preparation, and consumption of our meals and related services. By using the site or placing an order, you acknowledge this policy and agree to our Terms of Service and Privacy Policy, which are incorporated here by reference. If provisions conflict, the provision most specifically addressing the issue controls to the fullest extent permitted by law.
“Nutrifunction,” “we,” “us,” and “our” mean Nutrifunction Meals LLC and its owners, members, managers, employees, contractors, agents, affiliates, suppliers, and service providers, as applicable. This policy does not eliminate any right that cannot lawfully be waived.
2. Prepared foods and changing menus
Menus, ingredients, suppliers, portion sizes, availability, appearance, packaging, and preparation methods may change. Product photographs are illustrative. Substitutions may occur when reasonably necessary; we will not knowingly substitute a declared major allergen without appropriate disclosure. You must review the current product label, ingredient information, and handling instructions each time you order and before consumption.
We may refuse, limit, cancel, or correct an order affected by an obvious pricing or description error, suspected fraud, product unavailability, safety concern, legal requirement, or event outside our reasonable control. If we cancel a paid item before fulfillment, our obligation is limited to refunding the amount paid for that item.
3. Allergies, sensitivities, and cross-contact
Our kitchen handles foods containing milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soy, sesame, and other ingredients capable of causing allergic or adverse reactions. Although we use food-safety and cleaning practices, shared equipment, storage, preparation areas, suppliers, and airborne or incidental contact mean we cannot guarantee that any meal is allergen-free or free from cross-contact.
Website filters and labels are informational tools, not safety guarantees. “Gluten-free,” dietary, wellness, or allergen-related descriptions do not mean a meal was prepared in a dedicated facility unless expressly stated on the current label. If you have a severe or life-threatening allergy, celiac disease, or a medically significant sensitivity, do not rely solely on website filters and do not order or consume a meal unless you and your qualified medical professional determine it is appropriate after reviewing current written ingredient and facility information. Contact us before ordering if anything is unclear.
4. Nutrition and wellness information
Calories, macronutrients, micronutrients, serving sizes, ingredient contributions, wellness tags, and similar information are estimates derived from recipes, supplier data, databases, and calculation tools. Natural ingredient variation, substitutions, preparation, portioning, and calculation methods can cause actual values to differ. Information may contain errors or become outdated.
Nothing on this site or in our meals is intended to diagnose, treat, cure, or prevent disease or to guarantee weight loss, symptom improvement, laboratory changes, or any health outcome. General nutrition and wellness content is educational and is not medical, dietetic, pharmaceutical, or emergency advice. Consult an appropriately licensed professional regarding allergies, pregnancy, medications, chronic conditions, eating disorders, renal or metabolic restrictions, or any individualized health decision.
5. Optional meal plans and clinical partners
A suggested, filtered, or preloaded cart does not create a physician-patient, dietitian-client, fiduciary, or other professional relationship with Nutrifunction. Nutrifunction prepares and sells food; it does not independently diagnose conditions or prescribe medical treatment. Any recommendation from a separate clinician or practice remains that provider’s responsibility and does not guarantee that a meal is safe or suitable for you.
You remain responsible for reviewing every selected product, quantity, ingredient, allergen disclosure, nutrition value, price, and instruction before checkout and consumption. A linked clinician, practice, technology platform, Shopify, and Nutrifunction are separate parties unless expressly stated otherwise.
6. Pickup, custody, and food handling
You are responsible for timely pickup during the posted window and for maintaining safe temperature and handling after the order is transferred to you or your designee. Inspect packaging and temperature promptly. Refrigerate perishable food within two hours, or within one hour when exposed to temperatures above 90°F, and follow the product’s storage, use-by, freezing, thawing, and reheating directions. Keep refrigerated food at 40°F or below unless the label directs otherwise.
Do not taste or consume food with damaged or unsealed packaging, unexpected odor or appearance, evidence of temperature abuse, an undisclosed allergen, or any other safety concern. Discard food left outside safe temperature control or kept beyond its use-by date. We are not responsible for deterioration, contamination, illness, loss, theft, or damage occurring after transfer due to delayed pickup, transport, mishandling, improper storage, failure to follow instructions, or consumption after the use-by date.
7. Cancellation, returns, and refunds
- Final sale: Perishable food cannot be returned or resold. We do not accept change-of-mind returns or issue refunds for taste preferences, disliked ingredients that were disclosed, failure to review labels, customer ordering errors, or unused meals.
- Cancellation: An order may be changed or cancelled only if we receive the request before 5:00 p.m. Eastern Time on the Saturday preceding the scheduled Monday pickup and confirm the change in writing. After that deadline, orders are committed to purchasing and preparation and cannot be changed, cancelled, or refunded. Payment processing fees may be nonrefundable where permitted by law.
- Missed pickup: Orders not collected during the posted pickup window are not eligible for a refund. We may discard unclaimed food for safety reasons. Any courtesy hold or alternate pickup is discretionary and does not change this policy.
- Problems with an order: Report a missing, incorrect, damaged, or potentially unsafe item within 24 hours of pickup or receipt. Include the order number, item name, description of the issue, and photographs of the food, label, packaging, and date or lot information. Preserve the item safely if we ask to inspect it, but do not consume it.
- Available remedy: After review, we may provide a replacement, store credit, or refund for the affected item. Unless law requires otherwise, the remedy we select is your exclusive remedy and does not extend to unaffected items, inconvenience, travel, missed pickup, or third-party costs.
- Refund timing: Approved refunds are sent to the original payment method. Bank and payment-provider processing times are outside our control.
This policy is subject to applicable law and does not restrict remedies that cannot legally be limited.
8. Customer responsibilities
You represent that order information is accurate, that you are authorized to use the payment method, and that you will communicate these warnings and handling instructions to every person who receives or consumes the food. You are responsible for determining whether each product is suitable for each consumer and for supervising children or other vulnerable individuals.
Do not misuse the site, attempt unauthorized access, interfere with ordering systems, submit fraudulent claims, resell meals in a manner that removes required safety information, or use our content to make unsupported medical or commercial claims.
9. Third-party services
Shopify and other third parties provide hosting, checkout, payment, communications, maps, links, and related services. Their separate terms and privacy practices apply to their services. We do not control and are not responsible for third-party outages, acts, omissions, content, security, availability, or processing delays, except to the extent responsibility cannot lawfully be excluded.
10. Disclaimer of warranties
To the fullest extent permitted by law, the website, content, meals, recommendations, and services are provided “as is” and “as available.” We disclaim all express or implied warranties not expressly stated in writing, including merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and any warranty arising from course of dealing or usage of trade. We do not warrant uninterrupted access, error-free information, a particular health result, or suitability for a specific medical or dietary need.
11. Limitation of liability
To the fullest extent permitted by law, Nutrifunction will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, data, opportunity, or goodwill; or third-party costs, whether based in contract, tort, strict liability, statute, or any other theory, even if advised of the possibility.
To the fullest extent permitted by law, Nutrifunction’s aggregate liability arising from a claim will not exceed the amount you paid to Nutrifunction for the specific order giving rise to the claim. These limitations do not apply to liability that applicable law prohibits us from limiting, including liability finally determined to result from fraud, willful misconduct, or other non-waivable conduct.
12. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold Nutrifunction harmless from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the site or products, fraudulent conduct, unauthorized resale, alteration or relabeling of meals, failure to pass safety information to another consumer, or material violation of these terms. This obligation does not require indemnification for Nutrifunction’s own non-waivable misconduct.
13. Events beyond our control
We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, utility or internet failure, equipment failure despite reasonable maintenance, supplier interruption, labor disruption, government action, epidemic, emergency, transportation interruption, recall, or food-safety event. We may modify pickup, substitute or cancel items, or issue an affected-item refund as reasonably appropriate.
14. Ohio law, disputes, and severability
Except where prohibited by applicable consumer law, these terms are governed by Ohio law without regard to conflict-of-law rules. Any judicial proceeding must be brought in a state or federal court with jurisdiction in Stark County, Ohio, and each party consents to that venue and jurisdiction.
Before filing a claim, please send a written description of the dispute and requested resolution and allow 30 days for a good-faith response. Either party may seek relief in an eligible small-claims court. If any provision is unenforceable, it will be narrowed only as necessary and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver.

If you believe a meal caused a serious allergic reaction or foodborne illness, seek appropriate medical care first and then notify us promptly with the product and order details.
We may update this policy prospectively by posting a revised version and effective date. The version presented when you place an order governs that order unless applicable law requires otherwise.

These Terms of Service (the “Terms”) govern access to and use of the Nutrifunction Meals website, online store, content, ordering tools, communications, products, and related services (collectively, the “Services”). The Services are operated by Nutrifunction Meals LLC, an Ohio limited liability company (“Nutrifunction,” “we,” “us,” or “our”).
By visiting the website, creating an account, submitting information, placing an order, or otherwise using the Services, you agree to these Terms and to our incorporated policies. If you do not agree, do not use the Services or place an order.
These Terms contain important disclaimers and limitations of liability. Nothing in these Terms limits a right or remedy that applicable law does not permit us to limit.
1. Incorporated policies

If provisions conflict, the provision that most specifically addresses the issue controls to the fullest extent permitted by law. Our Legal Disclaimer, Food Safety & Refund Policy controls on food safety, allergens, nutrition information, cancellations, perishable-product returns, refunds, missed pickups, optional meal-plan support, and related liability.
2. Eligibility and authority
You must be at least the age of majority in your jurisdiction to place an order. If you use the Services for another person, organization, or household, you represent that you are authorized to act for them and that you will provide all applicable product warnings, labels, allergen information, and handling instructions to each person who receives or consumes the products.
You may not use the Services where doing so would violate applicable law.
3. Accounts and information
You agree to provide current, complete, and accurate ordering, contact, pickup, and payment information. You are responsible for activity under your account and for maintaining the confidentiality of account credentials. Notify us promptly if you suspect unauthorized access.
We may refuse service, suspend access, cancel an account, or cancel an order when reasonably necessary to address suspected fraud, abuse, unauthorized access, threats, unlawful conduct, safety concerns, repeated policy violations, or risks to customers, Nutrifunction, or third parties.
4. Products and availability
We sell fresh prepared meals and related food products. Menus, recipes, ingredients, suppliers, portions, availability, packaging, appearance, and preparation methods may change. Product photographs are illustrative and may not exactly represent the product received.
We may limit quantities, discontinue products, make reasonable substitutions, or refuse or cancel an order affected by an obvious pricing or description error, product unavailability, supplier interruption, recall, safety concern, suspected fraud, legal requirement, or event outside our reasonable control. We will not knowingly substitute a declared major allergen without appropriate disclosure. If we cancel a paid item before fulfillment, our obligation is limited to refunding the amount paid for that item.
You must review current product labels, ingredients, allergens, nutrition information, and handling instructions every time you order and before consumption.
5. Prices, taxes, and payment
Prices are shown in U.S. dollars unless stated otherwise. Prices, promotions, availability, and discounts may change before an order is submitted. Applicable taxes, fees, discounts, and the final order total are presented during checkout.
You authorize us and our payment processors to charge the payment method submitted for all amounts associated with your order. You represent that you are authorized to use that payment method. Payment processing is provided by third parties, including Shopify and its payment partners, and may be subject to their separate terms.
Promotional offers may be changed or withdrawn prospectively and may be subject to additional conditions. Unless expressly stated, discounts cannot be combined, transferred, redeemed for cash, or applied retroactively.
6. Order acceptance
An order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance. We accept an order when we begin fulfillment or otherwise confirm acceptance. We may contact you to verify information before accepting or fulfilling an order.
You are responsible for reviewing the cart, quantities, selected variants, pickup information, disclosed ingredients and allergens, prices, and contact information before completing checkout.
7. Changes and cancellations
We must receive any requested order change or cancellation before 5:00 p.m. Eastern Time on the Saturday preceding the scheduled Monday pickup, and we must confirm the request in writing. After that deadline, orders are committed to purchasing and preparation and cannot be changed, cancelled, or refunded. Payment-processing fees may be nonrefundable where permitted by law.
8. Pickup and transfer of responsibility
Orders are offered for pickup during the location and window selected or communicated at checkout. You are responsible for collecting the order on time and for maintaining safe temperature and handling after the order is transferred to you or your designated recipient.
Risk of loss and responsibility for storage, transport, handling, and consumption transfer upon pickup by you or your designee. Orders not collected during the posted pickup window are not eligible for a refund. We may discard unclaimed food for safety reasons. Any courtesy hold or alternative arrangement is discretionary and does not modify these Terms.
9. Perishable products, returns, and refunds
Because our meals are fresh and perishable, all food sales are final except when an item is incorrect, missing, materially defective, spoiled when timely received, or otherwise required by law. We do not accept change-of-mind returns and cannot accept returned food for resale.
Report a qualifying problem within 24 hours after pickup or receipt. Include your order number, the affected item, a description of the issue, and photographs of the food, packaging, label, and date or lot information. Do not consume food that appears unsafe. Preserve it safely if we request an inspection.
After review, we may provide a replacement, store credit, or refund for the affected item. Unless applicable law requires otherwise, the remedy we select is the exclusive remedy and does not extend to unaffected products, inconvenience, travel, missed pickup, or third-party expenses. Approved refunds are issued to the original payment method and remain subject to payment-provider processing times.

10. Allergens and dietary restrictions

12. Optional meal plans and third-party clinicians
A suggested, filtered, clinician-associated, or preloaded cart does not establish a physician-patient, dietitian-client, fiduciary, or other professional relationship with Nutrifunction. Nutrifunction prepares and sells food; it does not independently diagnose conditions or prescribe medical treatment.
A separate clinician or practice is responsible for its own professional recommendations. You remain responsible for reviewing every selected product, ingredient, allergen, nutrition value, quantity, price, and instruction before checkout and consumption. Nutrifunction, any clinician or practice, Shopify, and other technology providers are separate parties unless expressly stated otherwise.
13. Acceptable use
You may use the Services only for lawful personal or household purposes. You may not:
- violate laws or third-party rights;
- submit false, misleading, fraudulent, or harmful information;
- attempt unauthorized access to accounts, systems, data, or networks;
- interfere with the security, operation, or availability of the Services;
- introduce malicious code or use automated tools to scrape, overload, or exploit the Services;
- impersonate another person or misrepresent an affiliation;
- remove required labels or safety information;
- resell, repackage, alter, or relabel products in a misleading or unsafe manner; or
- use our content or products to make unsupported medical, nutrition, or commercial claims.
14. Intellectual property
The Services and their content—including text, graphics, photographs, recipes as presented, product descriptions, logos, designs, software, and compilation—are owned by Nutrifunction or its licensors and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for lawful personal use. No other rights are granted. You may not copy, reproduce, distribute, sell, create derivative works from, publicly display, or commercially exploit protected content without prior written permission, except as allowed by law.
15. Feedback and submissions
If you voluntarily send nonconfidential suggestions, ideas, reviews, photographs, or feedback, you grant Nutrifunction a worldwide, nonexclusive, royalty-free, sublicensable license to use, reproduce, adapt, publish, and display the submission for operating and improving the Services, subject to our Privacy Policy and applicable law. You represent that you have the necessary rights to the submission.
Do not submit confidential medical information through general storefront forms or reviews. Clinical information should be provided only through a specifically designated secure channel when instructed by the applicable healthcare provider.
16. Third-party services and links
Shopify and other third parties provide hosting, checkout, payments, communications, maps, links, and other functionality. Their separate terms and privacy practices apply. We do not control third-party services and, to the fullest extent permitted by law, are not responsible for their content, security, outages, acts, omissions, availability, or processing delays.
A link or technical integration does not constitute an endorsement or make Nutrifunction responsible for the third party.
17. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, CONTENT, PRODUCTS, RECOMMENDATIONS, AND RELATED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” NUTRIFUNCTION DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINFRINGEMENT, ACCURACY, AVAILABILITY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE ACCESS, COMPLETENESS OR ACCURACY OF INFORMATION, A PARTICULAR HEALTH RESULT, OR SUITABILITY FOR A SPECIFIC MEDICAL, ALLERGY, OR DIETARY NEED.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
18. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NUTRIFUNCTION WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, OPPORTUNITY, OR GOODWILL; OR THIRD-PARTY COSTS, WHETHER ARISING IN CONTRACT, TORT, STRICT LIABILITY, STATUTE, OR ANY OTHER THEORY, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, NUTRIFUNCTION’S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO A CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO NUTRIFUNCTION FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
These limitations do not apply to liability that applicable law prohibits us from limiting, including liability finally determined to arise from fraud, willful misconduct, or other non-waivable conduct. Some jurisdictions do not allow particular liability limitations, so portions of this section may not apply to you.
19. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Nutrifunction Meals LLC and its members, managers, employees, contractors, agents, affiliates, suppliers, and service providers from third-party claims, liabilities, losses, damages, and reasonable costs arising from your unlawful misuse of the Services or products, fraudulent conduct, unauthorized resale, alteration or relabeling of products, failure to pass safety information to another consumer, infringement of third-party rights, or material breach of these Terms.
This section does not require you to indemnify a party for that party’s own non-waivable misconduct.
20. Events beyond our reasonable control
We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, utility or internet outages, equipment failure despite reasonable maintenance, supplier interruption, labor disruption, government action, epidemic, emergency, transportation interruption, recall, or food-safety event. We may modify pickup arrangements, make reasonable substitutions, cancel affected items, or issue an affected-item refund as reasonably appropriate.
21. Governing law and disputes
Except where prohibited by applicable consumer law, these Terms are governed by Ohio law without regard to conflict-of-law principles. Any judicial proceeding must be brought in a state or federal court with jurisdiction in Stark County, Ohio, and each party consents to that jurisdiction and venue.
Before filing a claim, please send us a written description of the dispute and the requested resolution and allow 30 days for a good-faith response. Either party may bring an eligible claim in small-claims court.
22. Changes to the Services or Terms
We may modify the Services and may update these Terms prospectively by posting a revised version with a new effective date. The version presented when you place an order governs that order unless applicable law requires otherwise. Continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms.
23. Termination
You may stop using the Services at any time. We may suspend or terminate access when reasonably necessary for a violation of these Terms, fraud, unlawful activity, safety or security risk, or protection of Nutrifunction or others.
Provisions that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, liability limitations, indemnification, and dispute provisions—will survive.
24. General provisions
These Terms and incorporated policies constitute the agreement between you and Nutrifunction concerning the Services. If a provision is unenforceable, it will be narrowed only as necessary, and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our prior written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, financing, or operation of the Services.
Headings are for convenience only. “Including” means “including without limitation.” Electronic communications and records satisfy requirements that communications be in writing, subject to applicable law.

Nutrifunction Meals LLC (“Nutrifunction,” “we,” “us,” or “our”) operates this store and website and provides the related content, ordering tools, products, communications, pickup services, and optional meal-plan commerce features (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services.
This Privacy Policy explains how we collect, use, disclose, and retain personal information when you visit or use the Services, place an order, communicate with us, or otherwise interact with Nutrifunction. The pickup-eligibility check processes the complete address temporarily and attaches only the ZIP code, eligibility result, approximate distance, and verification time to the cart.
- Account information, such as your username, encrypted password or authentication information, preferences, saved settings, and account activity.
- Order and transaction information, such as products viewed or purchased, cart contents, quantities, discounts, pickup selections, order history, cancellations, refunds, and payment confirmation.
- Payment information, such as payment method, billing details, transaction identifiers, and payment status. Full payment-card information is generally collected and processed by Shopify and its payment providers rather than stored directly by Nutrifunction.
- Communications, such as customer-service requests, contact-form submissions, emails, telephone messages, reviews, survey responses, and information you choose to provide.
- Device and network information, such as IP address, browser, device type, operating system, language, network connection, and identifiers associated with cookies or similar technologies.
- Usage information, such as pages viewed, searches, products viewed, navigation, referring pages, approximate location derived from IP address, interactions with emails, and dates and times of activity.
- Preference and marketing information, such as communication preferences, promotions used, and inferred interests based on store interactions where permitted by law.
- Fraud and security information, such as signals used to detect suspicious transactions, abuse, unauthorized access, or other harmful activity.
- Limited meal-plan fulfillment information, as described below, when you use an optional clinician-connected or filtered meal-plan cart.
We may draw reasonable inferences from the information above, such as likely product preferences, subject to applicable law.
2. Meal plans, dietary preferences, and health-related information
Nutrifunction sells prepared food and is separate from any healthcare practice or clinician. The ordinary storefront is not intended to collect medical records, diagnoses, laboratory results, prescription information, or detailed health histories. Do not submit sensitive medical information through the storefront contact form, product reviews, ordinary email, or other unsecured channels.
If you use an optional meal-plan feature connected to a clinician or wellness provider, Nutrifunction may receive or process limited information necessary to prepare a suggested cart or fulfill selected products, such as product selections, dietary preferences, allergen-related selections, quantities, a generic fulfillment instruction, and an authorization or transaction identifier. The commerce bridge is designed to avoid placing patient names, diagnoses, laboratory findings, case identifiers, clinical reasoning, or other detailed clinical information in customer cart links or routine storefront communications.
A clinician or healthcare practice separately controls the health information it collects in connection with its professional services and should provide its own privacy notice. Nutrifunction does not represent that ordinary storefront information is protected by HIPAA. HIPAA applies only when and to the extent Nutrifunction is acting as a regulated covered entity or business associate for a specific activity. Other federal or state privacy and consumer-protection laws may still apply to health-related information.
We use health-related or dietary information only as reasonably necessary for the requested meal-plan, product-selection, safety, customer-service, legal, or operational purpose, or as otherwise authorized by you or permitted by law. We do not use detailed medical records submitted by a clinical provider for unrelated advertising.
3. Sources of personal information
We may collect personal information:
- directly from you when you browse, order, create an account, select pickup, communicate with us, or submit information;
- automatically from your browser or device through Shopify, cookies, pixels, tags, logs, and similar technologies;
- from Shopify, payment processors, fraud-prevention providers, analytics providers, email providers, and other vendors supporting the Services;
- from a clinician, practice, or meal-plan partner when you authorize or request a connected meal-plan or cart;
- from social networks, advertising partners, or other third parties where permitted by law; and
- from public sources or referrals when appropriate and lawful.
4. How we use personal information
We may use personal information to:
- provide, operate, personalize, maintain, and improve the Services;
- process payments, accept and fulfill orders, prepare products, coordinate pickup, issue confirmations, and handle cancellations, credits, or refunds;
- verify whether a submitted home address is within our stated pickup service area;
- create and manage accounts and remember preferences;
- create or present a requested filtered meal plan or preloaded cart;
- respond to questions, order issues, food-safety reports, allergy inquiries, complaints, or other communications;
- send transactional messages about orders, pickup, accounts, policy changes, safety notices, or recalls;
- send marketing or promotional communications where permitted, and honor opt-out choices;
- measure store performance, understand use of the Services, improve menus and content, and troubleshoot technical issues;
- authenticate users, detect and prevent fraud, investigate abuse, and protect the security and safety of customers, Nutrifunction, Shopify, and others;
- enforce our Terms and policies, establish or defend legal claims, and comply with law, court orders, subpoenas, regulatory requests, or other valid legal process;
- conduct business planning, auditing, accounting, recordkeeping, and corporate transactions; and
- carry out another purpose disclosed when the information is collected or with your direction or consent.
Where laws require a legal basis, we process information as needed to perform a contract, comply with legal obligations, pursue legitimate interests that are not overridden by your rights, protect vital interests, or based on consent.
5. Cookies and similar technologies
Shopify and other providers may use cookies, pixels, tags, local storage, and similar technologies to keep the store and cart working, remember preferences, maintain security, measure performance, understand browsing, and support advertising or personalization where permitted.
Some technologies are necessary for store, account, security, consent-preference, and checkout functionality. Others may be optional depending on your location and our configuration. You can manage available choices through the store’s privacy or cookie controls and through browser settings. Blocking necessary technologies may prevent parts of the Services from functioning.
Where required, we honor applicable opt-out preference signals, including Global Privacy Control, as supported by Shopify and applicable law. Browser “Do Not Track” signals are not uniformly recognized unless the law requires otherwise.

6. Marketing communications
We may send marketing emails or messages where permitted by law. You can unsubscribe using the link in an email or by contacting us. Opting out of marketing does not prevent transactional or service communications, such as order confirmations, pickup reminders, safety notices, or responses to your requests.
We do not authorize third parties to send marketing using detailed medical records. Shopify or advertising partners may use store browsing, cart, purchase, device, or cookie information for measurement or personalized advertising as described in their notices and subject to available privacy choices.
7. How we disclose personal information
We may disclose personal information for legitimate purposes to:
- Shopify, which hosts the store and provides commerce, checkout, account, analytics, fraud-prevention, and related services;
- payment processors and financial institutions to authorize and process transactions, refunds, disputes, and fraud checks;
- service providers supporting hosting, databases, security, analytics, communications, customer service, accounting, professional advice, fulfillment, or other operations;
- address-verification and mapping providers, as needed to determine pickup eligibility or, when you choose a directions link, provide a route to the pickup location;
- clinicians or meal-plan partners, but only as reasonably necessary to coordinate a service you requested, confirm product selections or fulfillment, address safety, or as otherwise authorized or legally permitted;
- marketing and advertising partners for measurement or advertising where permitted and subject to applicable opt-out rights;
- government authorities, regulators, courts, litigants, or law enforcement when required or permitted by law, valid process, safety needs, or protection of legal rights;
- parties to a business transaction, such as a merger, financing, reorganization, acquisition, sale, bankruptcy, or transfer of assets, subject to appropriate confidentiality and legal requirements; and
- other parties at your direction or with your consent.
We may also disclose de-identified or aggregated information that cannot reasonably identify you, subject to applicable law.
We do not sell personal information for money. Certain uses of cookies, advertising services, or Shopify enhanced services may be considered a “sale,” “sharing,” or targeted advertising under some state privacy laws even when no money is exchanged. Where applicable, you may opt out using the store’s privacy controls, a recognized preference signal, or the contact information below.
8. Relationship with Shopify
The Services are hosted by Shopify. Shopify collects and processes information about access to and use of the store to provide and improve commerce services. Information submitted through the store is transmitted to Shopify and may be processed by Shopify and its providers in countries other than your own.
We may use Shopify features that combine information from interactions with our store, Shopify, and other merchants to support fraud prevention, analytics, personalization, or advertising. For processing that Shopify controls, Shopify is responsible for its own practices and privacy requests.

9. Third-party websites and services
The Services may link to websites, social networks, maps, clinical-provider sites, or other platforms that we do not control. Their privacy and security practices apply to information you provide to them. We are not responsible for third-party privacy, security, availability, content, or accuracy. A link does not by itself imply endorsement.
Information you post publicly or semi-publicly, including reviews or social-media content, may be visible and used by others. Do not post confidential or sensitive health information in public areas.
10. Data security
We use administrative, technical, and physical safeguards designed to protect personal information in light of its nature and the risks involved. However, no storage, transmission, or security method is completely secure, and we cannot guarantee absolute security.
Use secure channels when available and do not send sensitive information through ordinary email or storefront forms. You are responsible for safeguarding account credentials and notifying us promptly of suspected unauthorized use.
11. Retention
We retain personal information only as reasonably necessary for the purposes described in this Policy, including fulfilling orders, maintaining accounts, providing requested services, meeting tax, accounting, food-safety, recall, recordkeeping, and legal obligations, resolving disputes, preventing fraud, and enforcing agreements.
Retention periods vary based on the information, relationship, legal requirements, operational need, and whether a dispute or investigation is pending. We may retain de-identified information where it cannot reasonably be linked back to you. Shopify and other third parties determine their own retention periods under their policies.
12. Your privacy rights and choices
Depending on where you live and subject to legal exceptions, you may have rights to:
- request access to or confirmation of personal information we process;
- request correction of inaccurate information;
- request deletion of personal information;
- receive a portable copy of certain information;
- opt out of certain sales, sharing, targeted advertising, or profiling;
- object to or restrict certain processing;
- withdraw consent where processing relies on consent; and
- appeal a decision concerning a privacy request where applicable.

We may need to verify your identity and request before responding. You may use an authorized agent where permitted by law, but we may require proof of authorization and direct verification. We will not unlawfully discriminate against you for exercising a privacy right.
Rights are not absolute. We may retain or decline to delete information when permitted or required for transactions, food-safety records, fraud prevention, legal compliance, disputes, or other lawful exceptions.
13. Children’s privacy
The Services are directed to adults and are not intended for children under 13. We do not knowingly collect personal information directly from children under 13 through the Services. Individuals under the age of majority may use the Services only through a parent or legal guardian.
If you believe a child provided personal information without appropriate authorization, contact us so we can review and take appropriate action. We do not knowingly sell or share the personal information of individuals under 16 for targeted advertising as those terms are defined by applicable law.
14. International transfers
Nutrifunction operates in the United States, while Shopify and other providers may process information in other countries. Those countries may have privacy laws different from those where you live. Where required, applicable transfer safeguards may include adequacy decisions, contractual protections, or other lawful mechanisms.
15. Complaints and appeals
Contact us first with questions or complaints about our privacy practices. Where applicable, you may appeal our response by replying to the decision or contacting us again with “Privacy Appeal” in the subject line. Depending on your location, you may also have the right to contact your state attorney general or local data-protection authority.
16. Changes to this Privacy Policy
We may update this Privacy Policy to reflect changes in our practices, Services, technology, or legal obligations. We will post the revised Policy, update the effective date, and provide additional notice when required by law. The version posted when information is collected generally governs that processing, subject to applicable law.
